Ukraine’s Crypto Legislation: Nearing Completion

The head of the National Commission for Securities and Stock Market (NKTSFR), Alexey Semenyuk, has shared updates on Ukraine’s cryptocurrency legislation. As reported by Incrypted, approximately 90% of the legislative text is ready, with finalization expected by August. However, some crucial questions remain open, including taxation policies and the legal status of crypto assets in criminal and enforcement contexts.

Progress Made: Key Legislative Agreements

Semenyuk emphasized that while August marks the completion of drafting, parliamentary approval will follow. A significant milestone achieved is the distribution of authority among government bodies. NKTSFR will spearhead as the primary regulator for virtual assets, complemented by a defined role for the National Bank.
Moreover, consensus has been reached on categorizing virtual assets per European MiCA regulations into asset-linked tokens, e-money tokens, and other virtual assets. Licensing rules for service providers related to these assets are also agreed upon, along with prudential requirements like capital adequacy and financial monitoring procedures.

The Roadblocks: Taxation and Legal Status

Despite substantial advancements, pivotal areas still require resolution. Taxation specifics—rates, bases, obligation triggers—are yet to be determined. Another unresolved domain is establishing a clear legal framework for crypto assets within criminal proceedings.
Semenyuk notes these aspects fall outside their core competence but are vital for comprehensive regulation. Discussions are ongoing regarding transition phases once laws come into force.

A Long Journey Towards Regulation

Efforts to regulate Ukraine’s crypto market have spanned several years. The draft law on virtual assets passed its first reading in September 2025 after extensive revisions. However, over 2,500 amendments were introduced later that year by parliament member Yaroslav Zheleznyak.
During the Incrypted Conference 2026, authorities announced plans to finalize the document by August 2026. They anticipate implementation from January 1st, 2027. Zheleznyak confirmed NKTSFR as Ukraine’s principal market regulator.
As Ukraine edges closer to enacting comprehensive cryptocurrency regulations aligned with global standards like MiCA, stakeholders eagerly await resolutions on remaining uncertainties that could significantly influence market dynamics and investor confidence globally.
