Spain Considers Stricter Taxation on Cryptocurrency Income

In an effort to regulate the burgeoning cryptocurrency market, Spain is contemplating significant changes to its tax legislation. The parliamentary group “Sumar” has introduced amendments aimed at tightening the regime for income derived from cryptocurrency transactions. According to CriptoNoticias, these proposals could increase the maximum tax rate on such income to 47%, up from the current 30%.

Proposed Legislative Amendments

The initiative seeks to amend three key laws:

  • Ley 58/2003, known as the “General Tax Law”;
  • Ley 35/2006, concerning “Income Tax”; and
  • Ley 29/1987, related to “Inheritance and Gift Tax”.

These changes aim to categorize earnings from crypto activities under personal income tax (PIT), with rates reaching up to 47%. Presently, Spain taxes this sector under savings income, with rates ranging between 21% for earnings of €6,000–€50,000 and up to 30% for amounts exceeding €300,000.

Impact on Institutional Players and Risk Assessment System

Moreover, institutional investors would be subjected to a flat rate of 30% on their crypto-related earnings. The proposal also includes establishing a risk assessment system by the National Securities Market Commission (CNMV). This system would evaluate investment platforms based on factors such as licensing, oversight, collateral sufficiency, and liquidity. The resulting risk levels would then be displayed publicly on service provider websites.

Criticism and Concerns Over Proposed Changes

Economist José Antonio Bravo Mateu criticized these reforms as “useless attacks” that may only lead to capital flight abroad. He argues that such measures could deter investment in Spain’s crypto sector rather than promote it.
Additionally, legal expert Chris Carrascosa pointed out that expanding executive power over seizing crypto assets—even those outside MiCA’s jurisdiction—lacks legal force and appears inconsequential. Many experts share concerns that these changes could stifle innovation within Spain’s taxation framework.

An Alternative Proposal for Bitcoin Taxation Regime?

Opposing this initiative is a proposal by Juan Faus and José María Gentile advocating for a special taxation regime specifically for Bitcoin. This idea was initially put forward in August 2025 but remains under consideration alongside Sumar’s amendments.

Implications for Spain’s Crypto Landscape

As Spanish authorities gradually tighten regulations over cryptocurrencies—evidenced by February’s announcement allowing asset seizures for unpaid taxes—the future holds significant challenges ahead if these stringent measures are enacted. While proponents aim at ensuring fair taxation across all financial domains including digital currencies like Bitcoin or Ethereum; critics warn against potential adverse effects hindering growth opportunities within this dynamic industry sector.
Ultimately though much depends upon how lawmakers balance competing interests when shaping policy decisions impacting both individual investors alike who seek clarity amidst evolving regulatory landscapes worldwide today!
