South Korea’s Regulatory Advice on Crypto Investments

Financial Supervisory Service (FSS) of South Korea recently issued guidance for local asset management companies to reduce their investment in shares of crypto-related firms such as Coinbase and Strategy, formerly known as MicroStrategy. This advisory aligns with existing rules from 2017 that prohibit regulated institutional financial counterparts from maintaining cryptocurrencies or derivatives on their balance sheets.

Current Regulations and Market Impact

While there is a noticeable trend towards deregulating virtual assets both in the United States and South Korea, no specific laws or guidelines have been established yet. Consequently, the current regulatory framework must be adhered to until a new system is operational. A representative of FSS emphasized this stance, explaining that despite recent developments, institutions should exercise caution in expanding their crypto investments.
This recommendation triggered dissatisfaction among ETF providers since these rules do not affect retail investors. Many exchange-traded funds in South Korea have significantly invested in American crypto companies. For instance, the ACE US Equity Best Seller ETF by Korea Investment Trust Management holds a substantial 14.6% share of Coinbase. Other ETFs like KoACT US Nasdaq Growth Company Active ETF also find themselves affected by this guidance.

Navigating Regulatory Challenges

The FSS acknowledges the difficulty of implementing changes, especially concerning passive ETFs. Thus, the primary aim is to encourage caution when launching new products amidst an evolving regulatory landscape in South Korea. Investors are hopeful for imminent regulatory updates following pro-cryptocurrency candidate Lee Jae-myung’s presidential election victory.
In conclusion, while these recommendations serve as a reminder of current restrictions for institutional investors, they also underscore potential shifts towards more flexible regulations in the near future. The ongoing dialogue between regulators and market participants highlights the dynamic nature of cryptocurrency investments and its evolving place within global financial markets.
