Brazil’s Tax Authority Seeks Compliance Data from Foreign Crypto Exchanges

Brazil’s Federal Revenue Service (RFB) is set to gather data on the activities of foreign cryptocurrency exchanges operating within its borders, according to a recent Reuters report. The tax authority will issue official requests and summon representatives of these exchanges to ensure their operations comply with Brazilian law.

Ensuring Legal Compliance and Taxation

The RFB’s primary concern is whether these foreign exchanges are adhering to local regulations and laws. Deputy Secretary for Inspections at RFB, Andrea Chavez, emphasized the need to scrutinize these operations for any illegal activities and obtain information on Brazilian wealth that may be subject to taxation. This examination will include the exchanges’ interactions with local virtual asset service providers.

Major Exchanges Under Scrutiny

Several prominent cryptocurrency exchanges, such as Binance, Coinbase, OKX, and KuCoin, operate in Brazil despite not being based there. These exchanges are now under the lens of the RFB as it seeks to understand their operational practices and ensure compliance with Brazilian law.

Rising Interest in Cryptocurrency

The RFB’s heightened interest in the digital asset sector correlates with a surge in activity among Brazilian crypto users. Between January and July 2023, Brazilians declared $24.6 billion in cryptocurrency assets, marking a 36% increase from the previous reporting period. Of this amount, $2.6 billion was linked to foreign crypto exchanges, a figure that has grown by 51.2% compared to the same period in 2022.

Significant Trading Volume

According to data from analytics firm Kaiko, the trading volume of cryptocurrencies paired with the Brazilian real (BRL) reached $6 billion from January to April 2024, highlighting the growing crypto market in Brazil.

New Legislative Developments

In a related development, the Brazilian Senate recently passed a bill imposing a 15% tax on income derived from digital assets. This legislative move further underscores the government’s intent to regulate and tax the burgeoning cryptocurrency market effectively.
The RFB’s efforts to engage with foreign cryptocurrency exchanges highlight the increasing regulatory scrutiny within the crypto industry. As Brazil continues to develop its regulatory framework, the impact on the global crypto market could be substantial, influencing how exchanges operate and comply with international standards.
