Coinbase Takes Legal Action Against SEC and FDIC

In a bold move, Coinbase has filed a lawsuit against the U.S. Securities and Exchange Commission (SEC) and the Federal Deposit Insurance Corporation (FDIC) for their refusal to respond to requests under the Freedom of Information Act (FOIA). The cryptocurrency exchange’s Chief Legal Officer, Paul Grewal, announced the legal action, citing the agencies’ lack of transparency and consistent regulation in the digital asset sector.

Allegations Against Financial Regulators

Coinbase’s lawsuit underlines several key issues. The SEC, despite claiming wide-ranging authority over the cryptocurrency market, has failed to provide clear and coherent regulatory guidelines. Grewal pointed out that the SEC’s approach is neither consistent nor transparent, creating significant challenges for crypto businesses.
Meanwhile, the FDIC is accused of exerting undue pressure on financial institutions to sever ties with the cryptocurrency sector. This, according to Coinbase, is an attempt to isolate the industry from the broader banking system, further complicating the regulatory landscape.

FOIA Requests and Specific Cases

The lawsuit stems from Coinbase’s efforts to obtain information under FOIA regarding specific investigations and regulatory actions. These include details on the “Ethereum 2.0” investigation and two closed SEC cases involving Enigma MPC and Ether Delta. Additionally, Coinbase sought information from the FDIC regarding its recommendations to financial counterparts about limiting expansion in the crypto sector. Despite these requests, both agencies declined to provide the requested documents, citing various reasons.

Call for Transparent Regulation

Grewal emphasized that such actions from regulatory bodies are contrary to the principles of transparent governance. He argued that the lack of clear guidelines and the agencies’ refusal to disclose pertinent information hinder the development and regulation of the cryptocurrency market. Coinbase is calling for greater accountability and clarity from financial regulators to foster a fair and transparent regulatory environment.
Previously, Coinbase had petitioned the SEC for rulemaking to clarify its regulatory authority. The exchange also sought judicial intervention to compel the SEC to respond to its requests. However, these efforts have yet to yield results.
