Peirce further explained that SEC registrants face ongoing uncertainty. It remains unclear which digital assets qualify as securities, who can act as qualified custodians, and whether activities like staking might breach regulatory requirements. According to her, this lack of clear standards poses serious barriers to market development.
Moreover, she emphasized that brokers and trading platforms unable to securely store crypto assets will struggle to effectively advance trading operations. To address these challenges, Peirce called for the establishment of clear rules that would allow safe handling of digital assets and broaden institutional participation in the market.

Commissioner Mark Uyeda echoed Peirce’s concerns by advocating for greater access to reliable custodial services. He proposed permitting state trust companies with limited liability to serve as qualified custodians for crypto assets. Meanwhile, newly appointed SEC Chairman Paul Atkins expressed his support for reforming crypto asset regulations.
