Manhattan Prosecutor Proposes Prison Sentences for Unlicensed Crypto Activities
In a significant move aimed at tightening the reins on unlicensed cryptocurrency operations, Manhattan District Attorney Alvin Bragg, alongside New York State Senator Zellnor Myrie, has introduced a legislative proposal known as the CRYPTO Act. This initiative seeks to elevate violations of crypto regulations from mere civil infractions to serious criminal offenses.

A Shift Towards Stricter Penalties

The CRYPTO Act is designed to enforce sterner penalties on companies dealing with virtual currencies without a state-issued license. Under this proposed legislation, offenders could face prison sentences ranging from five to fifteen years if they process transactions amounting to $1 million or more within a year without proper licensing.
Currently, New York addresses such infractions only through civil fines. However, federal laws and regulations in at least 18 other states have already criminalized unlicensed digital asset operations. The proponents of this bill argue that the existing gap fosters an environment conducive to the growth of gray and black market economies.

The Growing Shadow Financial System

District Attorney Bragg emphasized that the rapid expansion of the crypto market has contributed to the rise of a “shadow financial system,” which facilitates both the movement and concealment of illicit funds. He stated, “It is high time that companies operating without virtual currency licenses and neglecting due diligence face criminal accountability.”
Previously addressing students at New York’s law school, Bragg highlighted regulating the cryptocurrency sector as one of his priorities for his second term. He pointed out how criminals exploit regulatory loopholes for money laundering related to arms trading, narcotics, and fraud.

Criticism and Debate Over Current Regulations

The ongoing debate surrounding crypto regulations in New York occurs amid criticism of the existing BitLicense regime implemented in 2015. Former Mayor Eric Adams had described it as an innovation barrier due to high costs associated with obtaining licenses and compliance requirements.
Contrary to calls for easing these rules, this new proposal focuses on enhancing enforcement measures rather than relaxing them.
This legislative initiative marks a pivotal moment in New York’s approach toward cryptocurrency regulation by aligning more closely with federal standards while addressing growing concerns about unregulated financial activities within its borders.
