Maltese Regulator Fines OKX $1.2 Million for AML Compliance Violations

The Financial Intelligence Analysis Unit (FIAU) of Malta has imposed a significant fine on Okcoin Europe, the European branch of the cryptocurrency exchange OKX. The penalty amounts to $1.2 million due to breaches of anti-money laundering (AML) regulations in 2023. Despite notable advancements in regulatory adherence over the past 18 months, these infringements have been identified as systemic.

Key Compliance Shortcomings

FIAU’s investigation highlighted several critical deficiencies within OKX’s risk assessment system (BRA). These shortcomings hindered the platform from adequately evaluating money laundering threats and implementing appropriate measures. Among the identified risks were the use of cryptocurrency mixers, anonymous coins, stablecoins, and transactions on decentralized exchanges.
Furthermore, there were violations tied to servicing clients outside the European Union, contradicting their declared regional strategy. The regulator emphasized that OKX needed to consider potential threats from foreign users and funding sources more diligently.

Regulatory Challenges Beyond Europe

Adding to its regulatory woes, OKX faces legal action from Thailand’s Securities and Exchange Commission (SEC). The Thai SEC accused the platform and its operator Aux Cayes FinTech Co Ltd of providing services without proper licensing. If found guilty, the leadership could face two to five years of imprisonment along with substantial fines.
