Central Bank of Brazil Restricts Crypto Assets in International Payments

In a significant regulatory move, the Central Bank of Brazil (BCB) has announced updates to its eFX service rules through Resolution No. 561, which includes the prohibition of using crypto assets for cross-border settlements. This decision marks an important shift in how digital currencies are handled within Brazil’s international payment and transfer system.

Understanding the eFX Service

eFX (Electronic Foreign Exchange) is Brazil’s international payment and transfer system launched in October 2021. It facilitates individuals and businesses to pay for goods and services abroad, transfer money, and withdraw cash internationally without needing separate foreign currency accounts. The service is accessible to banks, payment institutions, brokers, and other BCB-authorized financial organizations.

Key Changes Under Resolution No. 561

A major change introduced by this resolution is the explicit ban on using crypto assets for transactions between Brazilian eFX providers and their overseas counterparts. All transactions must now be conducted exclusively through currency operations or Brazilian non-resident accounts. It’s crucial to note that these restrictions apply specifically to the eFX system; there is no outright ban on cryptocurrencies nationwide.
Furthermore, the resolution expands permissible transactions through eFX to include those related to financial market investments but imposes a $10,000 limit per transaction.

The Transition Period for Existing Providers

Companies already offering services under the eFX framework have until October 30, 2026, to register their activities within BCB’s Unicad system. Those operating without an official license must apply for payment institution status by May 31, 2027, or face ceasing operations within 30 days after the deadline.

Data Reporting Obligations

Providers are required to maintain all transaction data for ten years and report monthly activities to regulators by the tenth day of each following month.

Implications for Brazil’s Crypto Market

This regulatory update suggests that while digital currencies remain legal in Brazil overall, their role in certain regulated financial services like eFX is being curtailed significantly. Such measures could impact how global investors view Brazil’s stance on cryptocurrency integration into traditional finance systems.
The impending changes underscore a cautious approach towards integrating cryptocurrencies within formal banking structures while maintaining broader acceptance at a national level—a nuanced stance reflecting ongoing global debates around digital currency regulation.
With these developments set to take effect from October 1, 2026—with previous mandates requiring crypto asset service providers’ licensing aligning them with traditional financial entities—Brazil continues shaping its evolving landscape concerning digital currencies amidst rapidly changing technological advancements worldwide.
