Crypto Exchange and Service Provider Registry Now Mandatory in Argentina: A Comprehensive Overview

3 Min Read

In March 2024, Argentina’s regulator announced the creation of a mandatory registry for virtual asset service providers, affecting businesses and individuals involved in cryptocurrencies.

In a move that has sparked both concern and criticism, Argentina’s financial regulator has mandated the creation of a comprehensive registry for providers of virtual asset services (PSAV). This development, announced at the end of March 2024, signifies a pivotal shift in the oversight and regulation of cryptocurrency-related activities within the country.

### Mandatory Registration for Cryptocurrency Entities

The new regulation requires all companies and individuals whose activities involve cryptocurrencies to register with the authorities. This applies to organizations offering services such as the purchase, sale, transmission, or receipt of cryptocurrencies, digital asset trading, and lending services. Notably, the mandate extends beyond local service providers to include firms operating in the Argentine market but registered elsewhere.

### Critical Voices and Concerns

Roberto Silva, the president of the National Securities Commission (CNV) of Argentina, issued a stern warning: “Anyone who fails to register will not be able to provide virtual asset services in the country.” However, this initiative has not been without its detractors. Manuel Ferrari, co-founder of the Money On Chain protocol, harshly criticized the CNV’s move, arguing that Bitcoin operates as currency rather than a security and should not be subject to such regulatory measures. He likened the situation to currency exchange outlets or jewelry stores, which are not required to register with the CNV, highlighting the controversial nature of this registry.

### The Impact on Users and the Market

Despite regulatory intentions, some industry players, like Nicolas Bourbon, founder of the payment service KamiPay, believe that this regulation will not significantly impact users but rather aims to satisfy international organizational demands. According to Chainalysis, Argentina ranks 15th in the global cryptocurrency adoption index, indicating a high level of engagement with digital currencies among its population. This is further evidenced by the surge in Bitcoin investment amidst record inflation, showcasing the growing reliance on cryptocurrencies as a hedge against economic instability.

### Looking Ahead

As Argentina takes a significant step towards regulating the cryptocurrency landscape, the effects of this mandatory registration on the market, service providers, and the broader adoption of digital assets remain to be seen. While intended to bring clarity and security to the sector, the initiative has sparked a debate on the balance between innovation and regulation, reflecting the complex dynamics at play in the evolving world of cryptocurrencies.
